About the DePuy Hip Replacement Recall
On August 26, 2010, DePuy recalled two of its defective hip implant devices: the DePuy ASR XL Acetabular Hip System and the ASR Hip Resurfacing System. The medical recall affects all 93,000 devices that have been implanted since they became available in July 2003. Numerous complaints and studies have identified significant problems with DePuy medical devices, and DePuy has known for years that its hip implants are defective and prone to early failure.
Symptoms You Might Be Experiencing
Everyone is different, and their bodies react differently to medical devices. However, the failure of medical equipment can affect people more severely than they ever thought possible. If you have received a defective DePuy hip replacement, complications may include:
- Loosening and misalignment of the replacement hip
- Metal sensitivity/allergy
- Infection
- Bone fractures
- Hip dislocation
- Pain
It is estimated that at least one in eight patients who received the DePuy hip implants will have to undergo a second painful hip replacement surgery within five years. The metal-on-metal wear from the defective DePuy systems can also lead to an increase in toxic metal particles. As a result, patients may suffer from dangerous levels of chromium and cobalt in their blood. Even patients who have not yet noticed problems are at risk.
You May Be Entitled to Compensation
In general, you may be entitled to recover compensation for all of the harm and losses you have and will suffer, including the pain and suffering you have and will endure, the medical expenses, the costs of future surgeries and rehabilitation, as well as lost earnings. In fact, DePuy has announced that it intends to cover the reasonable and customary costs of monitoring and treatment related to defective hip replacements. However, this is misleading.
Reports are indicating that DePuy requires an extensive claims process, which requires you to give the company access to your medical records and the failed hip, which would otherwise be evidence. Then, if all of DePuy's conditions are met, it will only pay any out-of-pocket expenses that are not covered by your insurance.
Patients should be aware of their rights before contacting DePuy or Johnson & Johnson, and before signing any claims, releases or other documents. It is a good idea to talk with an experienced San Diego DePuy hip implant recall attorney about your options.
