Don’t Settle with the Insurance Company Too Early

It is imperative that you speak to a lawyer before discussing your case with the other party’s insurance company. Their only goal is to settle your claim as quickly as possible, and for as little money as they can manage. Without a personal injury lawyer by your side, it can be hard to tell just how much money you are entitled to. For this reason, we ask you to get in touch with The McClellan Law Firm as soon as you have been injured.

Our firm handles car accident claims related to the following:

We can negotiate with the insurance company on your behalf to ensure you get the money you deserve. If the insurance company is unwilling to offer a reasonable settlement, we will not hesitate to take your case all the way to trial. Having recovered tens of millions of dollars for our clients, our attorneys know how to navigate a difficult case. Don’t settle for less than what you deserve; come to The McClellan Law Firm first!

Property Owners Affected by Car Accidents

Car accidents do not only affect motorists and their passengers. Property owners, including homeowners and business owners, may be at risk of suffering serious injuries or damage to their homes or offices if vehicles veer off the road into their properties. Local residents and business owners who are struck by motorists or whose property is damaged in car accidents may be able to seek financial compensation for their injuries and losses.

Like we handle other car accident insurance claims and lawsuits, The McClellan Law Firm can handle these specific cases. Whether you were a customer in a restaurant or other business that was struck by a vehicle, were injured while in your home when a vehicle veered off the road, or are a business owner whose property has been damaged by a motor vehicle, we may be able to help.

Our San Diego car accident lawyers can talk to you about the incident and can work to identify at-fault parties to help you seek justice. Depending on the case, it may be the driver of the vehicle or another party who is responsible. If a vehicle part was defective, an auto manufacturer may be liable. If a defective roadway or traffic sign was to blame, the county or city government responsible for the roadway may be held accountable. We thoroughly investigate every case we take on to properly identify cause and establish fault.

Hit & Run Accidents Put Victims at Risk

It is important to remember that throughout San Diego and the state of California, it is against the law to flee the scene of an accident. In addition to being a criminal offense, hit and run accidents place injured victims at risk because they may not receive the medical attention they require in a timely manner. Although these two reasons should be enough to encourage drivers to stop at the scene of a collision, many still do not.

Many cases of hit and run involve drivers who were impaired. These drivers may make the decision to flee the scene rather than get arrested. Ultimately, it may be difficult to determine why a driver does not stop at the scene of an accident. For many who do not, they often describe the choice to flee as an unconscious, heat-of-the-moment decision. By educating motorists about these dangers and about the serious penalties they face, however, many safety advocates believe we can reduce the number of hit and runs on our roads. Many also suggest making hit-and-run penalties as severe, if not more, than penalties for driving under the influence.

Road Rage & Car Accidents

Merriam-Webster defines road rage as, "a motorist's uncontrolled anger that is usually provoked by another motorist's irritating act and is expressed in aggressive or violent behavior."

Road rage is dangerous because it increases the chances of a collision and may even provoke an intentional crash that could cause serious or life-threatening injuries. Road rage may even be considered a criminal offense if a driver intentionally causes a collision, and a driver could face felony charges for assault with a deadly weapon, battery causing great bodily injury, attempted murder or vehicular manslaughter, depending.

If you have been injured in an accident that was caused by an upset or aggressive driver, now is the time to talk to The McClellan Law Firm. Any car accident may be a harrowing experience, especially when another driver acts aggressively or violently. You have the opportunity to seek justice in civil court by working with a skilled car accident attorney at our firm, who can pursue a personal injury action against the responsible driver.

Fight for the Compensation You Deserve

Recovering after a car accident is challenging in many ways. Among the physical challenges, there can also be significant financial issues. Current medical costs, future rehabilitation costs, car repairs and income loss from days out of the office—it all adds up. How can you ensure your family has the money it needs during this time of recovery? Through a lawsuit, you may be able to recover compensation for more than just your car damage.

If you or someone you love was recently injured in a car accident, contact our firm to learn the legal recourse available to you. You may be entitled to financial compensation in the form of the following:

  • Economic Damages / Special Damages: Economic damages are specific losses that you have suffered. Unlike other times of damages, they can be calculated. Economic damages include:
    • Medical Bills: This includes past and current medical expenses as well as future medical expenses.
    • Lost Wages: You may be able to recover compensation for the income you lost during your recovery.
  • Non-Economic Damages / General Damages: Non-economic damages are damages that cannot be calculated but compensate the victim for very real losses, including:

    • Pain and suffering
    • Reduction in quality of life / Loss of enjoyment of life
    • Loss of sexual relations / Loss of consortium
  • Punitive Damages: In certain cases, such as drunk driving cases, a plaintiff can also ask for punitive damages. Punitive damages are meant to punish a driver for his or her actions.

Working with a law firm that understands the best ways to navigate a car accident lawsuit will put you in the best position to secure the maximum compensation possible. At The McClellan Law Firm, our attorneys have experience handling all types of cases.

Distracted Driving

Distracted driving is one of the single most dangerous hazards drivers face on California roads. According to the California Office of Traffic Safety, an estimated 80 percent of crashes involved an inattentive driver. More than 421,000 people were injured in crashes caused by a distracted driver in 2012 alone, and more than 3,000 people lost their lives. Cellphones are the number one cause of distraction for drivers, despite the fact that it is illegal to use them while behind the wheel.

Drunk Driving Accidents

While the overall number of drunk drivers has gone down because of the efforts of state legislature, law enforcement crackdowns, and community organizations, it remains one of the biggest dangers to drivers in California. Even though the law states that drivers may not operate a vehicle with a blood alcohol content (BAC) of 0.08 percent or higher – 0.04 percent for drivers of commercial vehicles – reckless drivers who choose to ignore this claim thousands of lives on the road every day.

Head-On Collision

While any type of car crash can result in a catastrophic injury, head-on collisions are among the most dangerous. Even at low speeds, these types of accidents put the safety of everyone involved at risk. While driver error is a common cause, poor roadway design, defective vehicles, and damaged roads can also cause a head-on crash.

Race Car & Exotic Auto Crashes

High-end sports cars may be highly coveted items, but what many people may not be aware of is just how difficult these vehicles can be to drive. When an inexperienced driver gets behind the wheel, they may overestimate their own ability to handle the car or may underestimate how it responds to even the slightest touch. Many crashes involving sports cars also occur at high speeds because of just how quickly these vehicles accelerate.

Rideshare Accidents

Uber, Lyft, and other types of rideshare vehicles generally make the roads a safer place by giving people an easy way to enjoy a night out without needing to worry about operating a vehicle in order to get home. However, that doesn’t mean that these vehicles are immune to car crashes – if you were injured in a crash while riding in one of these vehicles, you have several legal options available to secure compensation for your injuries.

Rollover Accidents

Certain types of vehicles, like some SUVs and other types of off-road vehicles, have a tendency to flip over during a crash because of their top-heavy designs. When a vehicle rolls in an accident, it exponentially increases the risk of serious injuries and fatalities. According to a study looking into motor vehicle deaths in 2010, researchers discovered that rollover crashes accounted for 35 percent of all traffic fatalities in passenger vehicle accidents, while these crashes only occurred just over two percent of the time.

Road Defects

While reckless drivers cause countless crashes every year, poor road design and defective roads contribute to a significant number of these accidents. A study conducted by the National Transportation Safety Board (NTSB) looking into the causes of wrong-way driving crashes identified confusing exit ramp design as one of the key factors in these types of crashes.

SUV Crashes

Many people settling down with their spouse choose to purchase an SUV in order to fit their growing family’s needs, but these vehicles aren’t necessarily the safest option. SUVs and other top-heavy vehicles are considerably more likely to roll in a crash, and many aren’t designed with this in mind. If vehicles’ roofs aren’t strong enough to remain relatively intact, they can collapse and crush the occupants of the vehicle.

Teen Drivers

Additional restrictions are placed on young drivers because many are not fully aware of the potential dangers and responsibilities that comes with operating a vehicle. Despite this increased focus on safety, drivers between the ages of 16 and 19 are nearly four times as likely to be involved in a car crash as any other driver.

Texting While Driving

California law explicitly prohibits drivers from interacting with their mobile devices without a hands-free device, while bus drivers and drivers under the age of 18 cannot even use hands-free systems. Despite these restrictions, hundreds of thousands of people are still injured in crashes involving a driver using a cellphone behind the wheel, and thousands more are killed. The National Safety Council (NSC) estimates that using your cellphone while driving will quadruple your chances of being in an accident on the road.

Underinsured Motorists

While drivers in California are required to maintain a certain level of insurance in order to be permitted to own and operate a vehicle, many crashes cause damage that exceeds these limits. If you were involved in a crash caused by an underinsured motorist, you may still have legal options available that can be used to secure the compensation you deserve.

Uninsured Motorists

Driving in California without the minimum insurance coverage is illegal, and a driver who does runs the risk of having his or her driver’s license suspended and vehicle impounded. Despite this, some national estimates report that about 20 percent of drivers don’t have car insurance. If you were involved in a crash caused by a driver without insurance, you may still be able to secure compensation.

Wrong-Way Driving Accident

While the overall number of car crashes has steadily declined over the past decade, the number of wrong-way driving crashes have remained constant. These types of accidents are not the most common, but they are incredibly dangerous and often result in death. The National Transportation Safety Board (NTSB) looked into causes of these crashes in 2012, and discovered that age, alcohol, and nighttime driving were three of the most common factors that led to wrong-way driving accidents.
