Cal/OSHA Scaffold Regulations & Common Hazards

California’s Title 8 scaffold regulations set detailed requirements that general contractors and subcontractors routinely cut corners on. Understanding these standards is central to building a liability case.

What Cal/OSHA Requires

Cal/OSHA requires every scaffold to be engineered to support its own weight plus four times the maximum intended working load. Substitutes for proper scaffolding, including lean-to structures, shore scaffolds, nailed brackets, loose brick, or stilts, are prohibited under Title 8 CCR §1637(j). Any scaffold or falsework taller than 36 feet requires a Cal/OSHA permit before erection or dismantling begins, and that work must be supervised by someone with documented training and experience in scaffold construction.

Common Causes of Scaffolding Accidents

Common causes of scaffolding accidents on San Diego construction sites include:

• Improper erection: Missing cross-bracing, inadequate base plates, or components installed out of sequence
• Absent or broken guardrails: Cal/OSHA mandates perimeter protection; gaps can lead to fatal falls
• Overloading: Stacking materials on a platform beyond its rated duty capacity
• Defective or rotted planking: Planks that fail under normal foot traffic
• Inadequate training: Workers sent onto scaffolding without instruction on load limits or hazard recognition

Effective July 1, 2025, Cal/OSHA lowered the fall protection trigger height for residential-type framing and roofing work from 15 feet to 6 feet. More job sites now require scaffolding or another compliant fall protection system, and violations of that standard can be relevant to liability.

Injuries Caused by Scaffolding Accidents

Scaffolding accidents produce two categories of harm. The first is a fall from height, caused by losing balance, tripping on an unsecured plank, or a collapse of the structure itself. The second is a struck-by injury, when tools, materials, or debris fall from an elevated platform onto a worker below. Both can be fatal or permanently disabling.

Injuries commonly seen in scaffolding collapse and fall cases include traumatic brain injury, spinal cord injury, fractures, and crush injuries. Severity depends on the height of the scaffold and what lies below the platform, but even a fall at moderate height can end a career in the trades.

Third-Party Liability in Scaffolding Accident Claims

Workers’ compensation is the starting point for most construction injury claims. It’s a no-fault system: injured workers receive medical benefits and a portion of lost wages regardless of who caused the accident. But workers’ comp doesn’t cover pain and suffering, loss of enjoyment of life, or the full scope of long-term financial loss. Under California law, an injured worker generally can’t sue their own employer directly.

This is where scaffolding cases become distinctive. On most job sites, the subcontractor who erects scaffolding is a different company from the one whose workers later use it. A framing crew builds the platform. An electrical crew works on it three weeks later when a plank gives way. The injured electrician’s employer didn’t build the scaffold, which means a third-party personal injury claim against the scaffolding subcontractor, the general contractor, a scaffold rental company, or the property owner may be available alongside the workers’ comp claim.

Third-party claims open recovery for damages workers’ comp won’t touch. California follows comparative negligence rules, so an injured worker can pursue damages even if they were partially at fault. Immigration status has no bearing on the right to seek workers’ compensation or personal injury damages under California law.
